What happens if you do not provide a W-8BEN before a payout?

What happens if you do not provide a W-8BEN?
If a US payer asks for a W-8BEN and you do not provide a valid one, the payer may be unable to document you as a foreign person and may withhold tax from your payment, or hold the payment until the paperwork is complete. Which outcome applies depends on your facts and on the payer's procedures, so treat the form as a condition of a smooth payout.

IRS Publication 515, Withholding of Tax on Nonresident Aliens and Foreign Entities, says that most types of US-source income received by a foreign person are subject to a 30% US tax unless a treaty reduces it, and that pay for services performed in the US by a nonresident alien is generally subject to withholding. It speaks to withholding agents in general.
Do not read that as a statement about your reward. Whether any withholding applies to a particular referral payment depends on facts such as where the work is done and your residence, and only a tax adviser can apply the rules to you.
What does the form do?
The form tells the payer who the beneficial owner is, where they live and whether they claim treaty benefits. The IRS describes it on its page about Form W-8BEN: foreign individuals give it to the payer when requested, whether or not they claim a reduced treaty rate. Entities use Form W-8BEN-E. So even if you expect no tax to be due, the payer still needs the form to say so on paper.
What does backup withholding have to do with partners?
It applies when a payer lacks a valid taxpayer identification number or certification for someone it pays. The IRS instructions for Forms 1099-MISC and 1099-NEC note that a Form 1099-NEC is required when backup withholding was withheld, whatever the amount. Reporting thresholds change from year to year, so do not rely on a figure remembered from an old article; read the current instructions or ask your adviser.
US persons give a W-9 and non-US persons a W-8 series form, which is why choosing the right one matters. Your home-country adviser can confirm which is yours.
Can you submit the form after payment?
Late is risky, and early is cheap. If the payer has already withheld, getting that money back can mean a refund claim, extra paperwork and delay, and the outcome is for your adviser to judge. Avoid the problem by providing the form when requested and before payment.

Common questions
Will missing the W-8BEN always trigger 30% withholding?
No. The 30% figure in IRS Publication 515 is a general rule for many kinds of US-source income received by foreign persons, subject to treaties and to what the income actually is. Whether it applies to a given referral payment depends on facts. A tax adviser should apply the rules to your case, not a general article.
Is backup withholding the same as nonresident withholding?
No. Backup withholding is tied to missing or incorrect taxpayer identification information, while nonresident withholding is tied to foreign status and the character of US-source income. They are described in different IRS materials, and the fix differs: a W-9 for US persons, a W-8 series form for foreign persons.
Can I send the form after I have been paid?
