Franchisor data monetization: which records are the franchisor's and which are not
Franchisors can consider licensing records they created and own, such as operations manuals, training content and franchisee support histories, but franchisee and customer data is governed by the franchise agreement and stays out unless rights are clear. Can a franchisor license its data?
A franchisor can license records it created and has the right to license. Records that belong to franchisees, or that describe their customers, are separate and usually stay out. The franchise agreement, the franchise disclosure document and any technology or data policy decide where the line sits, so a franchisor's counsel should review them before anything is scoped.

Revision histories show how a standard changed in response to experience.
Franchise-system data is also well organized by design: consistent categories, ticket types and training modules. But volume at the franchisor level may be thinner than at an operating company of the same revenue, so size and system depth still need checking.

What are the rights and confidentiality pitfalls?
Four recur in franchise systems.
- Franchisee data ownership. Many agreements say the franchisee owns or controls customer data collected at its location, while the franchisor has access or license rights. Do not assume.
- Required consents. Using franchisee-supplied financial reports or support content for a new purpose may require notice or consent under the agreement.
- State franchise rules and disclosure. State franchise laws and the disclosure document can affect how system information is used. The franchisor's franchise counsel should advise.
- Third-party content. Manuals often embed vendor, supplier or brand-partner material that the franchisor does not own.

How does the introduction work?
- Hand the franchisor's CEO or CFO your referral link, or submit the referral form with head-office headcount and years of operation.

Common questions
Who owns customer data collected at a franchised location?
It depends on the franchise agreement, the privacy notice and applicable law. Many agreements give the franchisee control of local customer data, others give the franchisor broad rights. Treat customer data as out of scope unless the franchisor's counsel confirms the right to license it.
Do franchisee employees count toward the 50-employee baseline?
No. The baseline looks at the company that would license the data. For a franchisor, that means its own head-office headcount at peak, with contractors excluded. Franchisee staff work for separate businesses and are not counted.
Are operations manuals licensable?
Often yes, when the franchisor wrote them and they contain no third-party licensed material. Manuals are most useful to buyers when paired with revision history and support records showing how the standards worked in practice. Counsel should review embedded vendor content and brand-partner material.
Does a franchisor need franchisee consent to license support tickets?
