# Brand standard exception case: a coastal variation | SourceX

The records that explain how a franchisor handled a brand standard exception are the inspection findings that flagged the problem, the franchisee's exception request with its evidence, the decision and its conditions, and the next inspection that should record the variation as approved rather than as a failure. Linked by a location identifier, they show a reviewer why the standard was set aside, who allowed it, on what terms, and whether the terms were kept.

This hard case sits under the guide to [procurement approvals and exception workflows](/guides/how-to-assess-procurement-approvals-and-exception-workflows), which defines a useful exception record as problem, authorized action and checked result. Here one franchise case is followed decision by decision, so a franchise systems consultant knows what a strong record trail looks like and how to spot one at a client.

## Inspection one and two: the finish keeps failing

Illustrative and invented for this page. A franchisor of quick-service restaurants has a 250-person corporate team and about 300 franchised locations. Its brand standards manual specifies one exterior finish and color for every building. A location two blocks from the ocean fails its exterior check twice.

| Date | Event | Who | Record it left |
|---|---|---|---|
| March, year 1 | Routine brand audit: exterior finish peeling and faded | Field auditor | Audit finding in the audit platform, scored as a fail, with photos |
| April, year 1 | Franchisee repaints to the standard | Franchisee | Contractor invoice uploaded to the franchise portal |
| February, year 2 | Next audit: same failure, same wall | Field auditor | Second audit finding, linked to the first by location ID |

Two failures on the same wall, with a repaint in between, turn a compliance issue into evidence that the standard does not fit the site.

## The request: a reasoned case for an exception

Rather than repaint a third time, the franchisee files an exception request through the franchise portal.

| Element of the request | What it contains | Record |
|---|---|---|
| The problem | Salt air and wind-driven spray degrade the standard finish within a year | Written reasoning in the portal request |
| The evidence | Both audit findings, before and after photos, the contractor's invoice | Attachments on the request |
| The proposal | A marine-grade coating in the closest available color match | Product data sheet from the coating supplier |
| The local factor | Other buildings on the same street use marine-grade coatings | Photos and a note from the contractor |

A request built like this is itself valuable: it shows how a franchisee argues from evidence against a written standard.

## The review and the conditional approval

The franchise operations director routes the request to the brand design team and the construction manager. Under the FTC Franchise Rule, a franchise involves the franchisor's mark and a significant degree of control over, or assistance with, the franchisee's method of operation; brand standards are where that control is written down, so a variation is a deliberate decision, not a favor.

| Step | Decision | Decided by | Record it left |
|---|---|---|---|
| Design review | Color match within tolerance at street distance | Brand design lead | Review note with a side-by-side color comparison |
| Construction review | Coating suitable; expected life of several years | Construction manager | Technical note on the request |
| Decision | Approve a regional variation for locations within a set distance of the coast | Franchise operations director | Decision in the portal with approver and date |
| Conditions | Approved coating only; annual photo check; variation ends if the location relocates | Franchise operations director | Conditions listed on the decision |

The decision goes further than the single location. Turning one request into a regional rule means later requests from coastal sites can cite it, which gives the record trail a second life as precedent.

## The proof: the next inspection reads the variation correctly

| Date | Check | Record | What it shows |
|---|---|---|---|
| May, year 2 | Location applies the marine-grade coating | Contractor invoice and photos in the portal | The condition on materials was met |
| February, year 3 | Brand audit records the exterior as "approved variation" | Audit finding referencing the decision ID | The audit platform knows about the exception |
| February, year 4 | Annual photo check passes | Photo submission in the portal | The variation held for a second year |

If the year 3 audit had scored the exterior as a fail, the case would show a different, also useful, problem: two systems that did not talk to each other. Either way, the trail is complete only when the outcome check exists.

## Why the trail is worth more than the manual

A brand standards manual says what every location must look like. It cannot show when the standard was wrong for a site, how a franchisee made the case, who weighed appearance against durability, or whether the compromise survived the next audit. The sequence above records all of that with dates and approvers. It is a worked example of rule-based judgment, the kind of real decision record an AI system cannot learn from a policy document alone.

Ownership is the open question. The audit findings and decisions are the franchisor's own work. Photos, invoices and reasoning that franchisees upload are a different matter: copyright exists from the moment a work is created, so who may license that material turns on the franchise agreement. The page on [franchise data ownership](/questions/franchise-data-ownership) covers this, and the franchisor's counsel decides it.

## Telling signs at a franchisor client

Franchise systems consultants, development advisors and private equity operating partners can spot franchisors with trails like this without seeing a record. Ask the franchise operations director:

- **Are there regional or site-specific variations from the standards manual?** Climate, zoning and historic districts are common reasons.
- **Where are exception requests filed and decided?** A portal, email or a mix.
- **Do the audit platform and the franchise portal share a location identifier?** Without it, the request and the next audit cannot be matched.
- **How many years of audits and decisions are kept, and who owns franchisee uploads under the agreement?**

Then introduce the person who can authorize a licensing discussion, the CEO, with the COO or the franchise operations director as working contact. The franchisor needs 50+ full-time employees at peak (contractors excluded), documented operating history, rights to license and an authorized contact. Companies in the U.S., Canada and the EU qualify, as do companies in the UK, Australia, New Zealand, India, Singapore, South Africa, Latin America, the UAE and Saudi Arabia when at least 90% of the data is in English. See [who qualifies](/who-qualifies) and the note on [franchisor versus franchisee employees](/questions/franchisor-employees-vs-franchisee-employees). What stays unknown until SourceX reviews it: export options for each system and whether buyers want these records. Consultants can read the [franchise consultant partnership page](/for/franchise-consultant-referral-partnership), and investors the guide to [private equity franchise platforms](/guides/private-equity-franchise-platform). ## Next step

> **Refer a company. Earn up to $100,000.** Default reward: 25% of Actual Supplier Payout, capped at $100,000 cumulatively per referred company. Eligibility and payment conditions apply, and a signed Schedule A or addendum can differ. A lead, meeting or signature alone does not trigger payment.

If a franchisor you advise has approved variations it can trace from audit to audit, [register as a partner](/register), confirm [who qualifies](/who-qualifies) and read the [program terms](/terms) before introducing its decision-maker.
